which is the"left"? The drawing above appears in the margin of this book several
times as a mnemonic for the clerk.)
Livestock Marks: Although within the
bounds of the early Town and village of Newburgh animals were required to be
confined (see Village and Town of Newburgh Records 1803-1838 for some of the livestock laws) fences did break and stock
did wander. For this reason, most people marked their young sheep, cattle, and
pigs in some way, so they could be identified and returned. Rather than
branding, the community followed the practice of their English, Scotch, Welsh,
and Irish forebears and used "earmarks,": usually slits, circles, or crops made
to the animal's ear. These marks were usually registered with the town clerk as
a central clearing house, and often passed on to sons and other relatives as an
inheritance.
Strays: when a stray domestic animal
was found the owner could not immediately be identified, it was kept in a
community pound for a stipulated period of time. a description of the animal was
entered with the clerk so that the owner of a missing animal could identify his
property (and pay a fine for having let it roam).
Slaves: When New York abolished
slavery, a "phasing out" procedure provided that children born to slaves after
July 4, 1799 would be considered bound servants, rather than slaves, and become
free at age 25 (females) or 28 (males). This in turn meant that a record of
slave births had to be kept, and since this was a new idea (and since slavery
was not particularly common in the area) the town clerk simply used the empty
space in the back of his "Livestock Marks and Strays" book for the purpose. (An
1817 law freed all slaves born before July 4, 1799, as of July 4, 1827).
Furthermore, the law did not permit the freeing of a slave who could not
support himself. This provision was intended to protect the aged and infirm (or,
more accurately, to keep them from becoming a burden on the community). An owner
who wanted to free a slave had to swear an affidavit that the slave was adult,
healthy, and under the age of 45.

of Orange do certify pursuivant to the seventh section of
the Statute of the State of New York entitled "An act relative to
Slaves and Servants passed March 31, 1817" that Susan a Slave (a Black woman at present owned by
James Butterworth of said town of Newburgh appears to be under the
age of forty five years and of sufficient ability to provide for
herself. In testimony whereof we have hereunto set our hands this

James Butterworth of Newburgh in the county of Orange, owner of a
certain Slave a Black woman called and Known by the name of Susan for
and in consideration of the Services heretofore rendered by the said
Susan and in and by authority of the Statute of the State of New
York in such case made and provided have manumitted freed and
forever liberated and by these presents do manumit free and forever
liberate the said Susan of and from her service and Slavery as
aforesaid To have and to hold her said liberty and freedom under her
the Said Susan from the day of the date of these presents forever in
as full and ample a manner as is contemplated and intended by the
said statute of the State of New York In testimony whereof I have
hereunto set my hand and seal this twenty first day of December one
thousand and Eight hundred and twenty four Sealed and delivered
